傳統藍血一脈的civil disobedience其實不只於和平理性非暴力,她背後擁抱的價值更是status quo、legitimacy of the government、support of the monopoly of the state violence、moral obligation to obey the law、submission and docility,是庶民對政權的苦心苦諫,最多只算是persuasion,有時連non-cooperation也算不上,遑論resistance了。這一串價值之能觸動人心,being effective,端在於這個社會still is almost just,因此還會以Justice的標準去吸納disobedient but civil的人民異見,有望歷時而改過。
然而,史上真有這款civil disobedience嗎?如有的話,又曾有過多少成效?Henry Thoreau不會認為跟墨西哥浴血開戰的政府是almost just吧?Gandhi更根本不承認殖民印度的British Raj,而Martin Luther King領導的民權運動,今天回看,其non-violence許是一時策略而非一生哲學吧。
其實,我們身歷我城這個六月天七月天,或許已對傳統藍血civil disobedience的理念理論愈來愈suspicious,而近年理論界也愈來愈對這款classical narrative of disobedience不耐煩,其中走得很前的一位是Candice Delmas。伊人曾拿過Dworkin-Balzan fellowship(大家一定明白我為何會星星眼心心眼!)在NYU作研究,去年刊出一卷A Duty to Resist: When Disobedience Should be Uncivil!伊人在書上argues for the fresh case that our political obligation shall include the duty to resist and to disobey the law...噫!
